The High Court of Telangana has stalled the auction of 40 vacant plots in Mayuri Nagar,
Miyapur by HMDA (Hyderabad Metropolitan Development Authority). The residents of Mayuri
Nagar, who are part of Mayuri Nagar Welfare Association in Miyapur had filed a petition against
HMDA’s intentions to auction the 40 vacant plots in Mayuri Nagar layout as auctioning/sale of
these 40 plots would mean that the common area space in the layout would be less than the
mandatory 10% of total layout size.
The petition was filed in court in 2018 by Mayuri Nagar Welfare Association. The Telangana
High Court has said that HMDA cannot auction the 40 vacant plots in question without first
providing ascertaining if the sale of these 40 vacant plots would reduce the mandatory 10%
space earmarked for open area, common facilities, recreational space & parks for residents of the
layout. The residents of Mayuri Nagar Welfare Association have houses built in a HMDA-
approved layout, which is also why HMDA cannot sell these 40 vacant plots if they reduce the
10% mandatory open space. The mandatory 10% open space for parks, recreation & open areas
is also one of the requirements for layouts to receive HMDA approval.
High Court Justice P. Madhavi Devi announced the High Court’s verdict to stall the HMDA
auction of 40 vacant plots in Mayuri Nagar after the court heard the 2018 petition filed by the
Mayuri Nagar Welfare Association. High Court judges directed officials of Hyderabad’s civic
body GHMC (Greater Hyderabad Municipal Corporation) & Hyderabad’s urban development
body HMDA to conduct an accurate survey of the layout along with representatives of the
association.
Justice P. Madhavi Devi said “If the survey confirms the fears of the association, then the auction
cannot be held. Needless to say, if the proposed auction is only for those plots which do not
encroach into the open areas of Mayuri Nagar, then the auction can be held. Officials should
ensure that 10% of the area is retained for open spaces and common facilities. Without the
approval of the state government, even HMDA cannot change this layout rule.”
