All Illegal Structures in Areas Under HMDA to be Demolished

Hyderabad’s local development body – Hyderabad Metropolitan Development Authority (HMDA) has taken the decision to demolish all illegal constructions that have been built within HMDA limits without obtaining permission to do the same. Most of these illegal structures have been constructed on land which was demarcated by the HMDA for other use or allocated for conservation/safety. Only last week, the Telangana government discovered a large multi-villa construction project which encroached and built more than 200 villas on FTL land adjacent to a lake in Mallampet village, Dundigal on the outskirts of Hyderabad.

A special memo was issued by the Special Chief Secretary of HMDA, Arvind Kumar notifying that many upcoming projects in HMDA limits which include residential apartments, gated communities and villas are under development without seeking valid permissions from the HMDA. The memo also notified that all these illegal projects will be demolished by the respective municipal corporations. The HMDA has ordered all the respective municipal commissioners of all the municipal corporations under them to begin taking strict action the aforementioned unlawful constructions. The Telangana government has asked the HMDA & the municipal corporations under it to carry out fast action against these illegal structures.

It has come to light that these illegal structures are using backdated permissions or fake permissions from the time before gram panchayats were merged with the municipal corporations in 2018. The gram panchayats even before the merging could only provide permissions for construction of ground+2 floors but the builders were using these permits for construction of villas, gated communities, residential units up to ground+5 floors. The commissioners of the municipal corporations under HMDA have been ordered to personally inspect and verify the legitimacy of permissions of ongoing constructions.

Any and all structures/illegal constructions found to have invalid permissions or is an unauthorized construction, then the memo issued by the Special Chief Secretary of HMDA allows the local municipal commissioners to take action & raze the structures under the provisions of the Telangana Municipalities Act 2019 & TS-bPASS Act. The HMDA has asked for reports of these illegal constructions and suitable action taken against them by 30th December 2021.
